name of the artist on Instagram with designated hashtag (#SapphireArt) All entries must be received by March 28, 2014 at 11:59 p.m. ET. 4. Entry Restrictions.Each uploaded photo will be counted as one (1) entry per person and is subject to the restrictions outlined below. Before entering the
Contest, the “Private” option in your Instagram account settings must be set to “OFF.”
During the Sweepstakes Period, upload a photo of artwork that inspires you featuring the piece and name of the artist and tag your photo with the hashtag #SapphireArt.
You may enter as many photos as you like as long as each photo is different. Photos must be uploaded in accordance with the Instagram Terms of Use
(http://instagram.com/about/legal/terms/). Do not use hashtag for purposes other than
Sweepstakes entry. In the event of dispute as to ownership of an entry, entry shal be deemed made by the authorized owner of the e-mail account associated with the
Instagram account from which the entry was made, as per e-mail account provider’s
records. Entries must be manual y key-stroked by entrant; use of programmed, robotic or like means to enter is prohibited. Sponsor is not responsible for entries that are lost,
late, il egible/garbled, corrupted, irregular, misdirected, stolen or incomplete and al such entries are void. Proof of transmission does not constitute proof of receipt or
proof of entry in Sweepstakes. Sponsor is also not responsible for (a) any incomplete,
incorrect or inaccurate information, whether caused by tampering, hacking, equipment malfunction/failure or other cause; (b) any error, omission, interruption, deletion,
defect, delay in operation or transmission of e-mails, communications line failure, theft
or destruction or unauthorized access to, or alteration of entries; and (c) any problems or technical malfunctions, disruptions or failures of any kind, including telephone
network or lines (including entries not received by Sponsor due to system failure,
disconnects, social media web site filtering or other reasons), computer on-line systems, servers or providers, software or programming or for damage to entrant’s (or
any other person’s) computer due to participation in the Sweepstakes.
5. Restrictions on Responses. Responses deemed by Sponsor in its sole discretion to
be inappropriate or unsuitable wil be disqualified. Entries must not: a) violate the rights
of third parties (including rights of trademark, copyright, publicity or privacy), b) contain
material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability,
sexual orientation or age, c) contain material that is unlawful, in violation of or contrary
to the laws or regulations in any state where photo is created, or d) contain material that features a competitive brand names or trademarks. ALL RESPONSES REFLECT
SOLELY THE OPINIONS OF INDIVIDUALS POSTING SAME, NOT THE OPINIONS OF SPONSOR OR NISSAN, SPONSOR AND NISSAN EXPRESSLY DISCLAIM ANY
AND ALL LIABILITY WITH REGARD TO THE CONTENT OF RESPONSES.
6. Drawing. Sponsor wil select the winners from among al eligible entries that have received
over 150 likes. Potential winner wil be notified via comment by Sponsor under entry, which
wil provide email address winner must contact to claim prize. Such notification wil occur
approximately 24 hours after selection in drawing. Potential winner must sign and return an affidavit of eligibility, a liability release and a publicity release (where lawful) within 5
business days. If potential winner cannot be contacted, fails to respond within 72 hours or
if he/she does not timely return signed affidavit/release, he/she wil be disqualified and an alternate winner selected from among al remaining eligible entries received.
7. Prize/Odds of Winning Prize – Monthly Prizes: Two (2) Lomography Cameras (ARV $100-$200) will be awarded to two (2) winners each month during the Sweepstakes Grand Prize: Two (2) tickets ($1,500 value each) to Russell Simmons’ annual Art for Life Hampton event will be awarded to one (1) grand prize winner to be selected at the end of the Sweepstakes Period. Odds of winning prize depend on the number of eligible entries that receive over 150 likes on Instagram. Any expenses related to acceptance/use of prize, which are not specified herein as wel as al taxes on prize are
winner’s sole responsibility. Winners wil be issued an IRS 1099 Tax Form for the fair
market value of the prize for the year awarded to winners. No prize substitution except by Sponsor in its sole discretion for prize/prize component of comparable value due to
unavailability of prize/prize component for any reason. Prize is not transferable.
8. Conditions of Participation. Personally identifiable information provided by persons in conjunction with the Sweepstakes is governed by Sponsor’s privacy policy (http://globalgrind.com/privacy-policy). It is entrant’s sole responsibility to comply with
the applicable rules, policies and guidelines of Instagram. In participating in the
Sweepstakes, you are providing your personal information to Sponsor, not to Instagram. Sponsor’s failure to enforce any provision of these Official Rules shal not represent the
waiver of same. Sponsor reserves the right, at its sole discretion, to disqualify any
individual it finds, in its sole discretion, to be tampering (or attempting to tamper) with the entry process or the operation of the Sweepstakes. But, disqualification shal not represent
Sponsor’s sole remedy under such circumstances. By accepting prize, except where prohibited by law, winners agree to the use of his/her name, address (city, state), likeness,
voice, photograph and/or other indicia of persona for advertising/publicity/trade purposes
by Sponsor and its designees without further compensation or notice. By participating, entrant indemnifies, releases and agrees to hold harmless Sponsor, Barcardi, their respective parent companies, subsidiaries, affiliates, divisions and agencies, and the directors, officers, agents, representatives, shareholders, employees, successors and assigns of any of the above organizations, and Instagram, from any and all liability arising from participating in the Sweepstakes, any Sweepstakes- related activity and/or acceptance, receipt, possession or use/misuse of prize. 9. FORCE MAJEURE. If, for any reason, the Sweepstakes (or any part thereof) is not
capable of running as planned by reason of computer virus, bug, system malfunction,
tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other
natural cataclysm, riot, strike, civil commotion, governmental regulation or any other causes beyond the control of Sponsor which, in its sole opinion, corrupt or affect the
administration, security, fairness, integrity or proper conduct of the Sweepstakes (or any
part thereof), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and conduct the Sweepstakes and select the prize winner in
a manner which is fair, equitable and in accordance with these Official Rules, as determined by Sponsor in its sole discretion. Notice of such action by Sponsor wil be
posted at thesocialartproject.tumblr.com.
10. DISPUTE RESOLUTION/GOVERNING LAW. To the fullest extent permitted by law, by participating in the Sweepstakes, you agree that: (a) any action at law or in equity arising out of or relating to these Official Rules or this Sweepstakes shall be filed exclusively in the federal or state courts of the State of New York and you hereby consent and submit to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action; (b) any such action shall be resolved individually, NOT as part of a class action; (c) any claims/judgments/awards shall be limited to actual out-of-pocket costs incurred, but NOT attorneys’ fees (or damages/remedies/relief of any other kind). These Official Rules and this Sweepstakes shall be governed by the substantive laws of the State of New York. 11.
